Judge Naime Krasniqi-Jashanica has been transferred to a lower division of the Prishtina Basic court after BIRN reported on her involvement in undermining the victim in a domestic violence trial.
The Kosovo Judicial Council, KJC, demoted Judge Naime Krasniqi-Jashanica after BIRN reported in September 2025 that, together with prosecutor Edina Jupolli, she discussed the case with a person accused of domestic violence before the trial, planning to deny the victim the right to speak in trial.
“Judge Naime Krasniqi-Jashanica is imposed the disciplinary sanction of transfer from the General Department-Criminal Division of the Basic Court of Prishtina to the Minor Offences Division of the same court,” the KJC decision reads.
In September 2025, BIRN published an April 2024 audio recording that had been recorded by the suspect in the case, who believed that he was being unjustly treated. In the recording, Krasniqi-Jashanica and Jupolli are heard discussing strategies to undermine the victim’s role in the trial, speaking privately with the defendant, Arton Tullari.
Rather than defend the victim, the officials are heard sympathising with the accused and planning to deny the victim her right to speak in court. “Judge, don’t let her open her mouth [to speak],” the prosecutor is heard saying after hanging up a call with the victim.
The victim, a mother of a four-year-old girl, according to the indictment from the Basic Prosecution of Prishtina, was allegedly beaten and threatened with murder by the suspect, Tullari, in front of her daughter. Tullari pleaded not guilty but was eventually convicted.
In the recording, Tullari says that, “if she starts speaking, we will be sleeping here [overnight]”, to which the prosecutor responds: “This is just a [trial] hearing, she will not be giving a statement at all because when [the suspect] is not guilty there is no need for anyone to declare, neither the prosecutor nor her [the victim], she has no right to give a declaration, only to sit there.”
The prosecutor then tells the accused that the victim “brainwashed me…. you were in detention for 48 hours [in regular procedure after arrest], it’s good that I didn’t send you to pre-trial detention.”
Tullari, is heard saying: “I swear to God, she has messed with my head for five to six years. It messed yours up in just five to six minutes.”
Judge Krasniqi-Jashanica agreed: “Yes, yes.”
The conversation reportedly took place in the judge’s office at the Basic Court, where the prosecutor suggested that the case should be “handled lightly”.
When contacted by BIRN, Krasniqi-Jashanica refused to offer an explanation, claiming that she was on leave and unable to comment. In November 2025, the judge was temporarily suspended. The prosecutor retired in July 2025.
In response to the scandal, the Prishtina Chief Prosecutor, Zejnullah Gashi, told BIRN last year that even though Jupolli is no longer serving, legal steps will still be taken if violations are confirmed.
“A final decision will be made based on all legal provisions in force,” the Basic Prosecution Office said in a statement. However, no decision had been made by the time of publication.
