President Osmani asks Constitutional Court to explain the legal steps, if MPs fail to inaugurate parliament beyond a July 26 deadline set by the court in June.
Kosovo President Vjosa Osmani on Tuesday said she had asked the country’s Constitutional Court to review the consequences of MPs’ failure to constitute parliament within a 30-day deadline set by the court.
“In fulfillment of my constitutional responsibility to guarantee the functioning of the institutions, I have submitted a request [for it] to review the conflict of constitutional obstacles created by the absence of parliament’s inauguration,” Osmani told the media.
“This blockage has brought about a situation in which parliament cannot exercise any of its competencies. The government continues to function with limited competences, while the main institutions, including the Presidency, cannot fully exercise constitutional competencies because of the lack of a parliament,” she added. “Many of the Presidency’s competencies are dependent on collaboration with the parliament.”
On Monday, Kosovo MPs failed for the 50th time to constitute the parliament.
In June, the Constitutional Court obliged MPs to constitute the country’s parliament within 30 days, ruling that although MPs took their oath on April 15, the inauguration of parliament remained incomplete because of the failure to elect a speaker.
Highlighting that this deadline expires on July 26, Osmani said that “neither compromise nor consensus is visible on the horizon”, and the earlier Constitutional Court ruling had not clarified “the consequences” of not constituting parliament within the 30-day deadline.
A constitutional review was “essential not only for this legislature … [it should be] clarified how the competencies of each institution are to be exercised in the absence of one of the main pillars”, meaning the parliament, she added.
The Central Election Commission officially certified the February election result on March 27.
The deadlock stems from the fact that, although the Vetevendosje party came first in the elections, it did not win enough seats to get its choice of speaker, acting Justice Minister Albulena Haxhiu, installed.
Opposition parties have repeatedly voted against Vetevendosje’s choice, which in turn has refused to compromise.
In May, Vetevendosje sought to create a parliamentary committee to hold a secret ballot on choosing a speaker. But on Monday, while 104 MPs were present in the 120-seat chamber, only 53 MPs voted to establish such a committee.
The opposition Democratic Party of Kosovo, PDK, Democratic League of Kosovo, LDK, Alliance for the Future of Kosovo, AAK, and Srpska Lista, all refused to submit names to be members of this committee, and did not participate in the vote, causing another attempted inauguration of parliament to fail.
On Saturday, acting PM and Vetevendosje head Albin Kurti met Fatmir Limaj, head of the Social Democratic Initiative party, NISMA, in an attempt to find a solution to the blockade.
On Monday, Faton Peci, a Vetevendosje MP and acting Minister of Agriculture, said Kurti had “offered [Limaj] co-governance” but without specifying exactly whether the position of speaker was offered to Limaj or not.
